Information sharing to subcontractors in support services, such as customer service, is permitted. All other use case categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties, excluding aggregators and providers of the Text Message services.
We may share your information only in the following limited circumstances:

Services
RapidScale Solutions provides AI-powered automation services for real estate professionals and other local businesses, including but not limited to: AI voice agents, automated text messaging, lead management, review generation, social media automation, and monthly performance reporting.
Client Responsibilities
- Provide accurate business information required to configure your system
- Ensure you have authorization to use phone numbers registered with our platform
- Comply with all applicable laws regarding contact with your leads and clients
- Maintain the confidentiality of your account credentials
- Use our services only for lawful business purposes
Payment Terms
- One-time setup fee is due prior to system configuration
- Monthly subscription fees are billed in advance on a recurring basis
- All fees are non-refundable except as required by law
- You may cancel your subscription at any time — no lock-in, no contracts
- Cancellation takes effect at the end of the current billing period
Cancellation Policy

Intellectual Property
All systems, templates, workflows, reports, and automation configurations built by RapidScale Solutions remain the intellectual property of RapidScale Solutions until full payment is received. Client-specific data (leads, contacts, reviews) belongs to the client.
Limitation of Liability
RapidScale Solutions shall not be liable for indirect, incidental, special, or consequential damages arising from your use of our services. Our total liability shall not exceed the fees paid by you in the three months preceding the claim.
Governing Law
These Terms are governed by the laws of the State of Texas. Any disputes shall be resolved in the courts of Collin County, Texas.
Changes to Terms
We reserve the right to update these Terms at any time. Material changes will be communicated via email with at least 30 days notice.
SMS Messaging Program
Program Description: RapidScale Solutions operates an SMS messaging program to communicate with leads and clients regarding AI automation services. Message types include lead follow-up, appointment reminders, review requests, onboarding updates, daily performance reports, and service notifications.
SMS Opt-Out Instructions
You may cancel SMS messages at any time. Text STOP to the number messaging you to unsubscribe. After texting STOP, you will receive one final confirmation message. No further messages will be sent. To re-subscribe, complete the opt-in form on our website.
The following keywords are recognized as opt-out requests: STOP, STOPALL, UNSUBSCRIBE, CANCEL, END, QUIT.

The following terms govern the SMS/text messaging program operated by RapidScale Solutions on behalf of its clients and for direct business communications.
Program Name: RapidScale Solutions AI Automation SMS Program
Program Description: Automated and semi-automated SMS communications including lead follow-up, appointment reminders, review requests, business updates, and AI-powered response sequences delivered on behalf of local business clients.
1. Opt-Out Instructions
You can cancel SMS service at any time. Simply text STOP to the number messaging you. Upon sending STOP, we will confirm your unsubscribe status via SMS. Following this confirmation, you will no longer receive SMS messages from us. To rejoin, sign up as you did initially and we will resume sending SMS messages to you.

For RapidScale Solutions Clients — Your Lead Opt-In
As a RapidScale Solutions client, your leads and clients must also opt in before your AI system can send them automated text messages. Here is how this works in your system:
How Opt-In Is Captured Automatically
- Web Forms: Every form on your landing page includes the required SMS consent language and checkbox
- Inbound Calls: When a lead calls your AI number, a verbal opt-in is recorded as part of the call flow
- Booking Pages: The calendar booking page includes SMS consent language required before confirming the appointment
- QR Codes: Any QR code linking to your forms captures opt-in at the point of submission
- Verbal Inbound Calls: When a lead calls your AI voice number, a verbal opt-in is recorded in the call flow transcript and logged in your CRM
Opt-In Record Keeping
For every lead or client opt-in captured through your RapidScale Solutions system, the following data is automatically recorded in your CRM:
- Date and time of opt-in (timestamp)
- Method of opt-in (web form, call, booking page, QR code)
- Exact consent language displayed at the point of opt-in
- IP address (for web form submissions)
- Phone number and contact identity
These records are maintained for the duration of your account plus a minimum of 5 years to satisfy TCPA and carrier audit requirements.
Important: You must never import a contact list and begin texting without verifying that each contact on that list has explicitly opted in to receive messages from your specific business. Purchased lists, shared leads, and contacts gathered before your RapidScale Solutions system was active require fresh opt-in before they can receive automated SMS.
T-Mobile Carrier Compliance
RapidScale Solutions operates in full compliance with T-Mobile's A2P 10DLC messaging policies, content standards, and non-compliance enforcement rules. All SMS programs run on behalf of our clients are registered, vetted, and approved through The Campaign Registry (TCR) prior to message delivery.
T-Mobile Non-Compliance Fines — Effective January 1, 2024
T-Mobile enforces strict financial penalties for violations. RapidScale Solutions maintains full compliance to protect our clients from these costs:
• Text Enablement Violation: $10,000 per incident (sending before program approval)
• Grey Route Traffic: $10 per message (sending A2P via unapproved P2P routes)
• Program Evasion: $1,000 per incident (number swapping, snowshoeing, or evasion tactics)
• Content Violations (Sev-0): Carrier-level escalation fees billed through service provider
A2P 10DLC Registration Status
All SMS programs operated by RapidScale Solutions are registered with The Campaign Registry (TCR) — the industry-standard clearinghouse required by T-Mobile, AT&T, and Verizon for all business-to-person (A2P) messaging.
Registration Components
- Brand Registration: RapidScale Solutions is registered as a verified business entity with TCR. Our EIN, legal name, address, and website are on file and verified.
- Campaign Registration: Each messaging use case (lead follow-up, appointment reminders, review requests, retention communications) is registered as a separate approved campaign with its own Campaign ID.
- Trust Score: Our registered brand holds a TCR trust score that determines message throughput and deliverability tier with T-Mobile and other carriers.
- Sole Proprietor Limits: Where applicable, messaging programs observe T-Mobile's sole proprietor limits of 1,000 messages/day per campaign and AT&T's limit of 15 messages/minute.
Prohibited Content — SHAFT Policy
T-Mobile and all major U.S. carriers enforce a strict prohibition on SMS content related to SHAFT categories. RapidScale Solutions does not send, and does not enable clients to send, any messages containing:
Adult content, explicit material, or sexually suggestive messaging of any kind.
Content that promotes discrimination, bigotry, or hatred toward any group.
Alcohol sales, promotions, or solicitation targeting unverified age recipients.
Sales, promotion, or distribution content related to firearms or weapons.
Tobacco, vaping, or cannabis products, promotions, or solicitation.
Payday loans, third-party debt collection, affiliate marketing, or phishing content.
T-Mobile Consent & Opt-In Requirements
T-Mobile requires that all recipients of A2P messages have provided explicit, documented opt-in consent before any message is sent. RapidScale Solutions enforces this at every touchpoint:
- Consent is Non-Transferable: Opt-in consent collected by one business cannot be shared with, sold to, or used by any other business or affiliate. Each consent is specific to RapidScale Solutions and the individual client it was collected for.
- No Pre-Checked Boxes: All opt-in checkboxes require active user selection. Pre-checked consent forms are strictly prohibited.
- Consent Language Required: Every opt-in form displays: the sender's name, message types to be received, frequency disclosure, "Msg & data rates may apply," and STOP / HELP instructions.
- Consent Records Maintained: Timestamp, IP address, opt-in method, exact consent language shown, and phone number are recorded for every subscriber.
- Single Opt-In Standard / Double Opt-In Best Practice: All programs meet single opt-in requirements. High-volume campaigns use double opt-in confirmation for additional protection.
T-Mobile Opt-Out & STOP Processing
T-Mobile requires immediate and permanent opt-out processing. Our systems comply with the following standards:
- Reply STOP to any message to immediately unsubscribe. Opt-out is processed instantly — the subscriber will not receive any further messages.
- A single one-time opt-out confirmation SMS is sent within 5 minutes confirming unsubscription. No further messages are sent after this confirmation.
- The following keywords are all recognized and processed as opt-out requests: STOP, STOPALL, UNSUBSCRIBE, CANCEL, END, QUIT.
- Reply HELP to receive program information and support contact details.
- Opt-outs are honored within 10 business days maximum per FCC 2025 rules — in practice, our systems process opt-outs in real time.
- Opted-out numbers are added to a permanent suppression list and are never re-enrolled without new explicit consent from the subscriber.
Quiet Hours & Message Timing
All automated SMS programs operated by RapidScale Solutions respect TCPA quiet-hour requirements:
- No automated marketing messages are sent before 8:00 AM or after 9:00 PM in the recipient's local time zone.
- Transactional and time-sensitive messages (booking confirmations, immediate AI responses) may be delivered outside these hours only when directly triggered by the recipient's own action.
- Message frequency is disclosed at opt-in. Actual frequency varies by program type and business activity.
Message Content Standards
Every message sent through RapidScale Solutions systems is reviewed against T-Mobile and CTIA content guidelines:
- No use of ALL CAPS throughout entire messages (spam signal to carrier filters)
- No use of shortened or masked URLs (e.g., bit.ly) — only full, transparent domain links
- Message purpose must match registered campaign use case — marketing messages are not sent under a customer care campaign registration
- No deceptive, misleading, or false information
- Business name or brand identification included in every message
FCC 2025 Consent Revocation Rule
Effective April 11, 2025, the FCC codified updated consent revocation standards. RapidScale Solutions complies with all three requirements:
- Any Common Language Accepted: Words such as STOP, CANCEL, QUIT, END, UNSUBSCRIBE are all recognized as opt-out requests — not just the word "STOP."
- Honored Within 10 Business Days: Revocation requests must be honored no later than 10 business days after receipt. Our systems process opt-outs in real time.
- One Confirmation Only: After a STOP request, one confirmation SMS may be sent within 5 minutes. No further marketing messages are sent after that confirmation under any circumstances.
